Terms of Service

1. The Service

Creative Image is an AI-powered portrait transformation platform. Registered users can upload portrait photographs, select from a library of AI styles (or provide custom text prompts), and receive AI-generated images. The Service operates on a prepaid credit system — credits are purchased in advance and consumed per generation.

2. Eligibility

• You must be at least 18 years old to use the Service.
• You must provide accurate registration information.
• You must not create an account on behalf of someone else without their explicit consent.
• Access to the Service from jurisdictions where it is prohibited by law is not permitted.

3. Account

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at legal@creative-image.site if you suspect unauthorised access. We are not liable for losses resulting from compromised credentials.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or are inactive for more than 24 months.

4. Credits and Payments

Credits are the in-service currency used to pay for generations. Credits are purchased via Stripe and added to your account balance upon successful payment.

• Credits do not expire as long as your account remains active.
• Credits are non-transferable and have no cash value.
• New accounts receive 30 complimentary credits on registration.
• Credit prices and pack sizes are as displayed at checkout and are subject to change. Changes will not affect credits already purchased.
• All prices are in USD and are exclusive of any applicable taxes. You are responsible for any taxes levied by your jurisdiction.

5. Refund Policy

As digital goods are delivered immediately upon purchase, all credit purchases are final and non-refundable, except where required by applicable consumer protection law.

If a generation fails due to a technical error on our side or our suppliers' side, the credits consumed for that generation are automatically refunded to your balance.

If you believe you are entitled to a refund under applicable law, contact us at legal@creative-image.site within 14 days of the transaction.

6. Acceptable Use

You agree not to use the Service to:

• Upload photos of minors or generate imagery that depicts minors in any sexual or exploitative context.
• Upload photos of another person without their explicit, informed consent.
• Generate content that is defamatory, harassing, threatening, or incites violence or hatred against any individual or group.
• Generate non-consensual intimate imagery ("deepfake porn") or any sexually explicit imagery of real, identifiable individuals.
• Impersonate public figures, politicians, or other identifiable individuals in a misleading or harmful manner.
• Attempt to circumvent our content moderation or the content policies of our AI providers.
• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international law.
• Resell, sublicense, or otherwise commercialise the Service itself (as distinct from the images you generate for your own use).
• Attempt to reverse-engineer, scrape, or otherwise extract data or models from the Service.

Violation of these rules may result in immediate account suspension, forfeiture of remaining credits, and, where appropriate, reporting to law enforcement.

8. Content Moderation

Our AI generation pipeline and third-party providers apply automated content moderation. Some generation requests may be rejected if they conflict with the content policies of our AI providers (currently NanoBanana AI and OpenAI). In such cases credits are automatically refunded.

We do not proactively review individual generated images, but we reserve the right to remove any content that violates these Terms or applicable law and to suspend the account responsible.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability.

AI-generated images may contain artefacts, inaccuracies, or unexpected results. We do not guarantee that any generation will meet your expectations.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid for credits in the 30 days preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

10. Service Availability

We aim to maintain high availability but do not guarantee uninterrupted access. We may suspend or discontinue the Service (or any part of it) at any time for maintenance, upgrades, or other operational reasons. We will endeavour to provide reasonable notice where possible.

If we permanently discontinue the Service, we will provide at least 30 days' notice and refund unused credits (calculated at a pro-rata rate based on the purchase price).

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Targovishte, Bulgaria.

If you are a consumer resident in the EU, you may also have the right to use the EU's Online Dispute Resolution platform: ec.europa.eu/odr.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

If you do not accept the updated Terms, you may close your account and request a refund of unused credits (where applicable by law) before the changes take effect.
